So when are you legally able to apply for a divorce?
You can apply for a Divorce after a separation period of 12 months. You can be separated but still live under the same roof. After the separation period you can apply to the court for a Divorce. It is also important to note that although you do not need the consent of both parties to file for a divorce, you must be able to show that satisfactory arrangements have been made for any children of the marriage that are under 18 years of age.

If you Divorce you have 12 months to finalise your property settlement and will need to deal with various financial matters including your will and superannuation.
